1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "you", or "your") and Lekkha Technologies ("Lekkha", "we", "our", or "us") regarding your use of the Lekkha business management platform and related services (the "Services").
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
2. Description of Services
2.1 Lekkha Platform
Lekkha provides a cloud-based business management platform designed for Indian small and medium businesses, including:
- Inventory Management: Track products, stock levels, and inventory movements
- Sales & Invoicing: Create GST-compliant invoices and manage sales transactions
- Customer Management: Store and manage customer information and relationships
- Business Analytics: Generate reports and insights about your business performance
- Payment Tracking: Monitor payments, outstanding amounts, and cash flow
2.2 Service Availability
We strive to provide 99.9% uptime for our Services. However, Services may be temporarily unavailable due to:
- Scheduled maintenance (with advance notice)
- Emergency maintenance or security updates
- Third-party service interruptions beyond our control
- Force majeure events
3. Account Registration and Security
3.1 Account Creation
To use our Services, you must:
- Provide accurate and complete registration information
- Be at least 18 years old or have legal authority to enter into contracts
- Have the authority to bind your business to these Terms
- Comply with all applicable Indian laws and regulations
3.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
- Using strong passwords and enabling two-factor authentication
3.3 Business Information
You must provide accurate business information including GST number, business address, and contact details. False information may result in account suspension or termination.
4. Acceptable Use Policy
4.1 Permitted Uses
You may use our Services to:
- Manage your legitimate business operations
- Store and process your business data
- Generate reports and analytics for business purposes
- Integrate with other business tools and services
4.2 Prohibited Uses
You may NOT use our Services to:
- Illegal Activities: Any unlawful purpose or activity prohibited under Indian law
- Fraudulent Activities: Creating fake transactions, manipulating data for illegal purposes
- Security Violations: Attempting to breach security, access unauthorized data
- Abuse: Harassing other users, sending spam, or misusing support channels
- Competition: Reverse engineering, copying, or creating competing services
- Harmful Content: Storing illegal, defamatory, or harmful content
4.3 Compliance with Laws
You must comply with all applicable laws including but not limited to:
- Goods and Services Tax (GST) regulations
- Income Tax Act and business reporting requirements
- Digital Personal Data Protection Act (DPDPA) 2023
- Information Technology Act, 2000
- Foreign Exchange Management Act (FEMA) if applicable
5. Payment Terms and Billing
5.1 Subscription Plans
Our Services are offered through various subscription plans:
- Starter Plan: ₹299/month for basic features
- Professional Plan: ₹599/month for advanced features
- Enterprise Plan: Custom pricing for large businesses
Plan details and pricing are available on our website and may be updated with notice.
5.2 Payment Processing
- Payments are processed in Indian Rupees (INR)
- We accept major Indian payment methods including UPI, cards, and net banking
- All payments include applicable GST as per Indian tax regulations
- Payment processing is handled by secure third-party providers
5.3 Billing Cycle
- Subscriptions are billed monthly or annually in advance
- Your subscription auto-renews unless cancelled
- Price changes will be communicated 30 days in advance
- No refunds for partial months, except as specified in our Refund Policy
5.4 Late Payments
If payment is not received within 7 days of the due date:
- Your account may be suspended (read-only access)
- Account termination after 30 days of non-payment
- Data retention for 90 days to allow payment and reactivation
6. Data Ownership and Privacy
6.1 Your Data
You retain ownership of all business data, customer information, and content you upload to our Services. This includes:
- Product catalogs and inventory data
- Customer lists and transaction records
- Business reports and analytics
- Any other data you input into the platform
6.2 License to Process
You grant us a limited license to process your data solely to provide our Services, including:
- Storing your data securely in Indian data centers
- Processing data to generate reports and analytics
- Backup and disaster recovery operations
- Providing customer support when requested
6.3 Data Export
You can export your data at any time in standard formats (CSV, Excel, PDF). Upon account termination, you have 30 days to export your data before permanent deletion.
7. Intellectual Property Rights
7.1 Lekkha's IP
The Lekkha platform, including software, design, features, and trademarks, is owned by Lekkha Technologies. You receive a non-exclusive, non-transferable license to use our Services.
7.2 Your IP
You retain all rights to your business data, logos, trademarks, and other intellectual property. We do not claim ownership of your content.
7.3 Third-Party IP
Our Services may include third-party components. You must respect all third-party intellectual property rights.

9. Disclaimers and Limitations
9.1 Service Warranty
Our Services are provided "as is" and "as available". While we strive for excellence, we cannot guarantee:
- Uninterrupted or error-free service
- Complete accuracy of all calculations or reports
- Compatibility with all third-party services
- Specific business outcomes or results
9.2 Business Advice
Lekkha provides tools and analytics but does not provide business, legal, tax, or financial advice. Always consult qualified professionals for business decisions.
9.3 Third-Party Services
We integrate with third-party services but are not responsible for their availability, security, or functionality.
10. Limitation of Liability
10.1 Liability Limits
Our total liability for any claims related to our Services shall not exceed:
- The amount you paid us in the 12 months preceding the claim, or
- ₹50,000, whichever is lower
10.2 Excluded Damages
We shall not be liable for:
- Lost profits, revenue, or business opportunities
- Data loss if you haven't maintained independent backups
- Indirect, consequential, or punitive damages
- Business interruption beyond our control
10.3 Your Responsibilities
You are responsible for:
- Maintaining independent backups of critical business data
- Ensuring accuracy of data you input into our system
- Compliance with all applicable laws and regulations
- Protecting your account credentials and access
11. Termination
11.1 Termination by You
You may terminate your account at any time by:
- Cancelling your subscription through account settings
- Contacting our support team
- Sending written notice to help@lekkha.com
Termination takes effect at the end of your current billing cycle.
11.2 Termination by Us
We may terminate your account if you:
- Violate these Terms or our Acceptable Use Policy
- Fail to pay subscription fees after notice
- Engage in fraudulent or illegal activities
- Misuse our Services or abuse our support team
11.3 Effect of Termination
Upon termination:
- Your access to Services will be suspended
- You have 30 days to export your data
- Your data will be permanently deleted after 30 days
- No refunds for unused subscription periods (except as per Refund Policy)
12. Legal and Dispute Resolution
12.1 Governing Law
These Terms are governed by the laws of India. All disputes shall be subject to the exclusive jurisdiction of courts in Bengaluru, Karnataka, India.
12.2 Dispute Resolution
Before initiating legal proceedings, both parties agree to attempt resolution through:
- Direct Negotiation: Good faith discussions between the parties
- Mediation: Non-binding mediation in Bengaluru if negotiation fails
- Arbitration: Binding arbitration under Indian Arbitration Act if mediation fails
12.3 Force Majeure
Neither party shall be liable for delays or failures due to circumstances beyond reasonable control, including natural disasters, government actions, internet failures, or pandemic restrictions.
13. Changes to Terms
We may update these Terms periodically. For material changes, we will provide 30 days notice via:
- Email to your registered email address
- In-app notifications
- Notice on our website
Continued use of our Services after the effective date constitutes acceptance of updated Terms.
14. Miscellaneous
14.1 Entire Agreement
These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Lekkha regarding our Services.
14.2 Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.
14.3 Assignment
You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
14.4 Waiver
Failure to enforce any provision does not constitute a waiver of our rights to enforce that or any other provision in the future.
